1. The structural trap: attaches at building permit, bites at Occupancy Permit
When S.R. No. 87/2026 was finalised after public consultation, early-stage building permit application documents (Regulations 24 and 29) were removed from the required contents of a Building Manual. That meant builders and developers do not have to prepare a draft Building Manual at the time they apply for their building permit.
Removing upfront paperwork at building permit stage created a two-phase project management trap:
- At Month 0 (building permit application), for any Class 1b, Class 2, Class 3, or mixed-use Class 2/3 building where the building permit application is made to a building surveyor on or after 1 February 2027 (reg 205B), the statutory obligation attaches. Nothing has to be compiled on day one, so site teams focus on demolition, structure, and lock-up.
- At Month 16–22 (3 weeks before Practical Completion), works are finishing and the Contract Administrator prepares the Schedule 4 Form 15 Application for Occupancy Permit. Under Regulation 6 and Regulation 8 of S.R. No. 87/2026, Form 15 and Regulation 186(2)(b)(iii) require the application to be accompanied by "a draft building manual, if required under section 41A of the Act, which contains the information required under regulation 205C".
Under section 41A(1) of the Building Act 1993, the person applying for an occupancy permit must prepare a draft building manual in accordance with the regulations and ensure it accompanies the application made to the Relevant Building Surveyor (RBS). Under section 41B(1) and (3), the RBS approves the draft building manual only if satisfied it meets all prescribed requirements, and gives a copy of the approved building manual to the applicant at the same time as issuing the Occupancy Permit. If the draft manual is incomplete against Regulation 205C, the RBS withholds approval and the Occupancy Permit does not issue.
2. What a 2-to-4 week Occupancy Permit delay actually costs
For a small-to-mid builder or developer delivering an 8-to-25 unit Class 2 apartment project or Class 1b/3 building, a delayed Occupancy Permit is the most expensive point on the programme to discover a documentation shortfall.
At Occupancy Permit stage, construction debt is fully drawn. Every calendar day that the Relevant Building Surveyor withholds the Occupancy Permit waiting for missing Regulation 205C items compounds three simultaneous financial losses:
| Cost category at OP stage | Why an incomplete manual triggers it | Typical impact on an $8M–$18M multi-res project |
|---|---|---|
| Senior debt & mezzanine holding interest | Construction facility is 95–100% drawn at PC/OP. Without the issued Occupancy Permit, plan registration and purchaser settlement triggers cannot fire. | $2,200 – $5,500+ per calendar day ($30,000 to $75,000+ across a 2-week documentation delay). |
| Liquidated damages & preliminaries overrun | Under AS 4000, AS 4902, and ABIC contracts, both the Occupancy Permit and essential O&M handover documents are preconditions to Practical Completion. | $1,500 – $4,000+ per day in contractual LDs plus ongoing site insurances, temp power, and site supervision. |
| Withheld retention & final progress claim | The Superintendent or Contract Administrator will not issue the Certificate of Practical Completion while statutory or contractual manuals remain unapproved. | 2.5% to 5% of contract sum locked up past the scheduled handover month. |
Spending three weeks at the end of a build waiting on subcontractors to send warranties, commissioning certificates, and asset service-life tables costs ten to twenty times more in holding interest than compiling the manual ahead of time.
3. Why subcontractor chasing fails after final claims are paid
The hardest part of assembling either an AS 4000 Practical Completion O&M manual or a Victorian Regulation 205C draft Building Manual is extracting accurate documentation from 15 to 25 separate trades and consultants while they are demobilising to their next job.
Under Regulation 205A and Regulation 205C(l)–(m), a compliant draft Building Manual requires both permit documentation (s 221ZH plumbing and s 44 electrical certificates) and structured operational records:
- A complete list of assets and information (reg 205A) covering chattels, fixtures, fittings, and services on common property or common areas (explicitly including lifts, heating systems, ventilation and air-conditioning systems, water pumps, fire safety systems, and back-up generators) together with each asset's location, replacement cost, maintenance schedule, and expected service life; and
- Copies of all warranties (reg 205C(m)) relating to the construction of the building, installed equipment, and installed systems integral to the function, operation, and safety of the building for which an unlimited owners corporation is responsible.
If your Contract Administrator asks mechanical, fire, hydraulic, and lift subcontractors for replacement cost figures and expected service-life tables after their final progress claim has been certified, emails go unanswered. When Handover Manual is booked 4 to 8 weeks before target Practical Completion, trade document deliverables are audited before final retention and progress sign-offs occur.
4. Staged permits and the post-OP 28-day sequence (s 41A(2), Reg 205D, s 44A)
Three statutory sequencing rules govern the final handover transition in Victoria:
| Stage | Statutory reference | Requirement |
|---|---|---|
| 1. Staged building permits | Section 41A(2) (Building Act 1993) | Where a prescribed building is constructed under multiple staged building permits (such as Stage 1 piling/basement and Stage 2 superstructure/fitout), the requirement to submit the draft building manual applies in respect of the application for the final occupancy permit. All Regulation 37 permits, Regulation 39(1)(b) documents, Regulation 38 performance solution determinations, and Section 84/Reg 113 protection work notices from earlier stages must be preserved and included under reg 205C(c)–(e). |
| 2. Post-OP 28-day attachment | Regulation 205D (S.R. No. 87/2026) | Once the RBS gives the applicant a copy of the approved building manual (s 41B(3)) and issues the Occupancy Permit, the applicant must attach the issued Occupancy Permit to the approved building manual within 28 days after being issued with the permit. |
| 3. Owner / OC handover & BPC lodgement | Sections 41B(4) & 44A; Regulation 205I | The applicant must provide the approved building manual to the building owner or to the Owners Corporation at its first meeting (s 44A). From 1 January 2028 (reg 205I), a copy of the approved building manual with the attached Occupancy Permit must also be provided to the Building and Plumbing Commission within 28 days after the OP is attached. |
We allocate compilation slots by target Practical Completion and Occupancy Permit month so your trade chasing, council Section 30 reconciliation, and Regulation 205A asset schedule are completed before your surveyor conducts the final inspection.
